Web Hosting - Terms of Service (TOS)

These Terms of Service (the "Agreement") set forth the terms and conditions of Your Use of hosting and related services ("Services"). In this Agreement "You" and "Your" refer to You as the user of Our Services, or any agent, employee, servant or person authorized to act on Your behalf. "We", "us" and "our" refer to Kenny Interactive Hosting, as well as its subsidiaries and sister companies (“Kenny Interactive Hosting”). This Agreement explains Our obligations to You, and explains Your obligations to Us for the various services or products offered by Kenny Interactive Hosting (“Services”). When You use Your account or permit someone else to use it, You signify Your agreement to these terms.

1. Term of Agreement; Modification

   You agree that Kenny Interactive Hosting may modify this Agreement at any time. Continued use of Services constitutes acceptance of those changes.

2. Accurate Information

   You agree to maintain accurate, current, and complete information. Failure to do so may result in suspension or termination.

3. Privacy

   Your use of Services is subject to our Privacy Policy. By using our Services, you agree to its terms.

4. Accepted Use Policy

   You agree to use Services only for lawful purposes. Any activity deemed abusive, harmful, illegal, or disruptive is strictly prohibited and may result in immediate action, including suspension or termination.

5. Fraud, Scams, and Abuse

   You agree not to use Kenny Interactive Hosting Services for any fraudulent, deceptive, or illegal activities, including but not limited to scams, phishing operations, impersonation, financial fraud, or misleading schemes.

   Kenny Interactive Hosting reserves the right to investigate any account or activity suspected of such behavior and may take action based on suspicion alone to protect our systems, customers, and reputation.

   • Immediate suspension or termination without notice;

   • Removal or disabling of content;

   • Permanent ban from Services;

   • Reporting to law enforcement or authorities where applicable.

   No Refund Policy: Accounts terminated due to fraud, scams, or abuse are not eligible for refunds under any circumstances.

   You acknowledge that Kenny Interactive Hosting has sole discretion in determining what constitutes fraudulent or abusive activity.

6. Storage and Security

   You are responsible for maintaining backups, security, and confidentiality of your account. Kenny Interactive Hosting is not responsible for data loss.

7. Ownership

   All intellectual property rights related to the Services remain with Kenny Interactive Hosting or its partners.

8. Third-Party Software

   Third-party software is provided “as is” without warranties. Use of such software is at your own risk.

9. Billing and Payment

   All fees are due according to your billing cycle. Failure to pay may result in suspension or termination of Services.

10. Chargebacks and Payment Disputes

    You agree that initiating a chargeback or payment dispute for valid services is a violation of this Agreement.

    In the event of a chargeback or payment dispute:

    • Your account may be immediately suspended or terminated without notice;

    • All data, files, and content may be permanently deleted;

    • No refunds will be issued;

    • Reinstatement may require additional fees;

    • Your account may be permanently restricted from future use.

    Collections: Any unpaid balances or reversed charges may be submitted to a collections agency. You agree to pay all associated recovery costs, including administrative and legal fees.

    Required Resolution Attempt: You agree to contact support and attempt to resolve any issue prior to initiating a dispute.

    We reserve the right to dispute any chargeback using account records, service logs, IP data, and agreement acceptance records.

11. Termination & Cancellation

    Kenny Interactive Hosting may terminate Services at any time if you violate this Agreement. No refunds will be issued for violations.

12. Limitation of Liability

    Services are provided “AS IS” without warranties of any kind. Kenny Interactive Hosting shall not be liable for any damages, including loss of data or business interruption.

13. Indemnification

    You agree to indemnify and hold harmless Kenny Interactive Hosting from any claims arising from your use of Services.

14. Governing Law

    This Agreement shall be governed by the laws of the United States and applicable state jurisdiction.

15. Final Agreement

    This Agreement constitutes the entire agreement between you and Kenny Interactive Hosting and supersedes all prior agreements.
